Membership Agreement

1. GENERAL TERMS AND CONDITIONS
In these Terms & Conditions and the Membership Rules, “Lake Fork Unplugged” means MARTIN’S MAP, 4530 State Hwy 31 N Longview, Texas and whose registered office is at that same address; “Member” means the member named on the Application Form, and “Membership” is the membership by a Member of a Club, which starts when MARTIN’S MAP accepts the proposed Member’s Application Form; “Club” means the MARTIN’S MAP Site at https://www.lakeforkmaps.com web site at which the Member applied for membership and any other MARTIN’S MAP web site that the Member may attend; “Contract” means the contract between MARTIN’S MAP and the Member subject to these Terms & Conditions and Club Rules; “Application Form” means the application form completed by the Member to join the Club; “Club Rules” means the terms set out in the MARTIN’S MAP Membership Rules.

2. MEMBERSHIP APPLICATION
Membership is subject to these Terms & Conditions as amended from time to time. Submission of an Application Form is an offer to MARTIN’S MAP to become a Member of the Club subject to these Terms & Conditions and the club rules. MARTIN’S MAP reserves the right to reject any application for Membership. Membership is available to individuals of 18 years of age and over, subject to status.

3. MEMBERSHIP TYPES
Paid in Full Memberships
For this package type, full payment is required upfront, and the Membership will automatically expire at the end of the term of the contract. Members may then renew their Membership at the prevailing rate for their package type. MARTIN’S MAP offers only a “Paid in Full” type of Membership package at this time. MARTIN’S MAP reserves the right, in the future to introduce, withdraw and vary categories for Membership qualification.

4. CANCELLING YOUR MEMBERSHIP
Paid in Full Memberships will expire automatically at the end of the specified term, unless the Member chooses to renew their Membership. A Member may cancel for a full refund at anytime within 14 days from the first day of the initial membership application. No refunds are applicable for any portion of membership dues paid past those 14 days unless agreed upon by Martin’s Map.  In order to cancel a Membership, the Member wishing to cancel, would need to send a certified letter to Martin’s Map, 4530 State Hwy 31 N, Longview, Texas 75603 and provide the name and address that the Membership was purchased under.  The letter must be post-marked no later than 14 days past the Member’s date of purchase in order to qualify for a full refund.  The Member would need to provide a working telephone contact number, and a date of initial Membership in that letter.  These are requirements that the Member is fully responsible for and Martin’s Map assumes no responsibility when these conditions are not met to Martin’s Map’s satisfaction.  Once qualifications have been verified, a representative will contact the Member and arrange for a refund. 5. TERMINATION OF MEMBERSHIP BY MARTIN’S MAP
MARTIN’S MAP may terminate a Membership without notice and with immediate effect if:
1. The Member breaches these Terms & Conditions or the Club Rules, either repeatedly or because of one serious breach;
2. Violation of Martin’s Map copyright or trademark rights, or rights of other’s companies featured within.
3. Any due fees remain unpaid after any request for payment by MARTIN’S MAP;
4. MARTIN’S MAP is of the opinion (acting in its discretion) that the Member is not suitable for continued Membership;
5. The Member puts the health, safety or well-being of staff or other Members or Guests at risk.

This is a private membership site and pictures, articles, maps, may not be used outside of this site for any purpose other than personal use only.  All decisions made by MARTIN’S MAP under this clause are final and binding. MARTIN’S MAP is unlikely to accept a new application for Membership from someone whose Membership has been terminated in accordance with this clause.

6. CHANGES TO MARTIN’S MAP TERMS & CONDITIONS
MARTIN’S MAP may from time to time amend these Terms & Conditions, including the introduction of any additional terms and conditions, and will notify Members by placing a notice on the Club notice board. Any changes will be effective immediately.

7. THE TERMS OF YOUR CONTRACT
The failure of MARTIN’S MAP to enforce any of its rights at any time for any period shall not be construed as a waiver of those rights. Any failure to identify or act upon a breach of the Terms & Conditions or Club Rules shall not be deemed to be an affirmation by MARTIN’S MAP that the behavior of the Member or Guest is acceptable. Except where permitted by this Contract, neither MARTIN’S MAP nor the Member may alter the terms of this Contract without the express agreement of the other.

8. LIMITATION OF LIABILITY
MARTIN’S MAP shall not be held responsible for any inaccuracies of material covered within, GPS coordinates, or other informational comments made. Anglers using any of the content held within should be self aware and personally responsible for the numerous lake hazards that they may encounter when on this lake. They should expect the unexpected which can be: floating logs, stumps in boat lanes and open water, shallow water areas, other boaters who don’t pay attention, and various other hazards. Personal Member lake use of GPS Coordinates mentioned within this site are intended to allow Members to find a particular structure only. It is not intended for general Navigation purposes.  A careful navigator never relies on only one method to obtain position information. The hazards present in this lake are too numerous to list and MARTIN’S MAP will assume no responsibility to do so.

9. ACCEPTANCE OF YOUR CONTRACT
Acceptance of all the Terms And Conditions of this contract shall be agreed upon by said Member when Membership has been paid for. At that time, Martin’s Map will assume that the Member has agreed upon and accepted all of the Terms and Conditions set forth when this transaction occurs.
